Management of personal information is taken very seriously by Inspiring Vacations Pty Ltd (Inspiring Vacations, we, us or our) and our policies and processes are aimed at ensuring all information collected is handled according to the Australian Privacy Principles (APPs) as directed under the Privacy Act 1988 (Cth) (Privacy Act).

The Privacy Act and the APPs regulate the way personal information (including sensitive information) is collected, used, disclosed, stored, and destroyed, and how an individual may gain access to or make complaints about personal information and sensitive information held or compiled about them.

This Privacy Policy describes how we collect and process the personal information of our customers. By submitting your personal information to us, you acknowledge that you have read and understood, and agree to the use of your personal information in accordance with this Privacy Policy.

This Privacy Policy does not apply to the personal information of Inspiring Vacations’ employees (employees should contact HR for further information).

If you are resident in a country outside of Australia, our privacy obligations to you may be different. Please refer to Annexure A of this Privacy Policy or contact us for further information.

Personal Information: Any information or an opinion about an identified individual or a reasonably identifiable individual is considered personal information. Such information might include name, address, phone number, date of birth, drivers licence, passport, etc. Some of your information that has been de-identified (such that it is not capable of re-identification) is no longer considered personal information.

Sensitive Information: The following sub-sets of personal information are considered to be sensitive information: information or an opinion about an individual’s racial or ethnic origin, political opinions, political association membership, religious beliefs or affiliations, philosophical beliefs, professional or trade association membership, trade union membership, sexual orientation or practices, criminal record, health information (e.g., medical conditions, dietary requirements, allergens or adverse medical events suffered) and genetic information. As above, your passport in particular might disclose sensitive information to us.

In order to fulfil bookings made with Inspiring Vacations, it is necessary and unavoidable that we request certain personal information and sensitive information. All information is handled according to this policy and we only request information that is necessary to produce the highest quality travel service.

Information That We Collect

The kinds of personal information we collect from you or about you will depend on the transaction you have entered into with us, the type of travel service you have engaged with us to provide, and the services you are interested in.

We aim to collect personal information by lawful and fair means, in accordance with the Privacy Act, the APPs and other applicable laws. We aim to collect personal information for purposes which are reasonably necessary for, or directly related to our business functions, the provision of our services, and other activities as permitted by law. This includes, for example:

• When you contact us asking for information on our travel services and product offerings;

• When you ask to be on an email or mailing list relating to our business and its services;

• When you book with us, and for activities related to that travel booking.

During our booking process, you will typically be asked to provide your full name, date of birth, passport number, passport expiry, nationality, mailing address, email address, travel preferences, emergency contact details and any medical conditions that might impact the operation or continued safety of all those travelling. Under the Inspiring Vacations Terms & Conditions, it is necessary to provide such information in order for us to process your booking.

Credit card details are not collected by Inspiring Vacations and nor should they be volunteered. All credit card details are processed by Mint Payments or Braintree, our trusted third party payment gateways that are fully compliant with the Payment Card Industry Data Security Standards (PCI DSS). We may collect bank details for the purposes of processing refunds.

In addition to the personal information that might be collected by or disclosed to us as part of your enquiry or booking transaction, various non-identifiable information is collected in relation to every visitor to our site, or who otherwise interacts with us electronically. Such details may involve geographical tagging, cookies, IP address, onsite behaviour and interaction with digital marketing on third party websites. This information cannot be associated with any individual and is used to constantly improve the service provided to you. Cookies used cannot be used to access information stored on your computer. By using our website you agree that we can record this information from your device and access them when you visit the site in the future. If you would prefer to disable cookies etc, please refer to the instructions in your relevant web browser. Please note that by deleting our cookies or disabling future cookies you may not be able to access certain areas or features or our website. Inspiring Vacations will communicate with you on an anonymous or pseudonymous basis where it is practical to do so and there is no legal requirement to request your true identity. Verification of identity will only take place when you make contact with Inspiring Vacations regarding an existing booking or account.

How We Collect Information

We aim to primarily obtain personal information or sensitive information (as applicable) only directly from you through customer booking forms, however any interaction with Inspiring Vacations may involve the provision of personal information or sensitive information. This might include email, phone, social media, account registration or online chat. That information may be provided by you directly or by someone else to whom you have provided consent to submit personal information. If you are providing personal information with regards to a third party (eg, your next-of-kin or emergency contact), you acknowledge that you have received their consent to do so.

The completion of a booking with Inspiring Vacations, the provision of personal information or sensitive information through any other means, or the continued use of this website, all of which are entirely voluntary in nature, shall be taken as consent to use such information in a manner outlined in this policy.

We will ensure that any unsolicited personal information will be afforded the same privacy protection as solicited personal information. Where unsolicited person information is received by us:

• we will assess whether we could have lawfully collected the information directly from you, and

• if not, then we will destroy or remove identifying components in the information as soon as practicable, but only if it is lawful and reasonable for us to do so.

Why We Collect Personal Information

It is necessary and unavoidable that we collect personal information for the primary purpose of fulfilling bookings or requests for quotes made with Inspiring Vacations. As such, this information will be communicated to third party service providers including airlines, hotels, tour operators and other transport or travel operators. In some instances, the third party service providers may have direct access to our database for the purpose of providing the required service for you.

Where personal information is withheld, it may not be possible for such services and any other provided by Inspiring Vacations to be provided. Certain personal information may also be requested in order to respond to an enquiry.

If you have provided us with any sensitive information for a particular purpose, we will only use it for that purpose, unless you have provided your consent to use it for other purposes.

Personal information may also be used for other secondary purposes reasonably expected to be carried out by Inspiring Vacations, including those related to administration, fraud, marketing, content improvement, research, post-bookings or/and post-trip feedback surveys, statistical analysis, resolving technical issues and quality control.

We may also collect, hold, use and disclose your personal information in circumstances that are required or permitted by law, where that is necessary for us to comply with our legal obligations. For example, information may also be provided to government bodies for the purposes of confirming your ability to travel, arranging visas and necessary registrations, where required to do so by law.

Personal information will be held by Inspiring Vacations until it is no longer required for any of the listed functions at which point it will be deleted or destroyed. This may extend beyond the completion of your travel.

Your personal information will never be sold to third parties but may be transferred in the event of a business sale, merger, change of control, transfer of assets or any other reorganisation.

Where we wish to use or disclose your personal information for other purposes, we will obtain your consent.

In the event that we do not collect, hold, use or disclose your personal information and sensitive information, or if you do not consent, then we may not be able to answer your enquiry, complete the transaction you have entered into, or provide the travel services that you have engaged us to provide.

How We Store Personal Information

Information will generally be stored in an electronic format, but may also be in paper form. Security measures are aimed to protect the personal information and sensitive information about you from and against unauthorised access, use, alteration, modification, disclosure or destruction. We take reasonable measures to do so. We have included reasonable security safeguards for electronic and physical records.

Our reasonable technical safeguards include:

● Limited access levels for our employees so your personal information can remain restricted;

● Using passwords to restrict computer access and requiring regular changes to passwords for our employees;

● Using secured online systems to store information; and

● Using secured onsite and offsite facilities to store information.

Inspiring Vacations prioritises the security of your personal information and any other sensitive information that is collected, by taking reasonable measures such as employing security industry-standard encryption methods and restricting access to authorised personnel only. Our commitment extends to implementing comprehensive security measures—organisational, technical, and physical—to mitigate risks such as accidental loss, unauthorised access, alteration, or disclosure of data.

Inspiring Vacations’ other reasonable technical safeguards include:

• using secured online systems to store electronic copy records; and

• using secured onsite and offsite facilities to store information.

While we adhere to widely accepted security protocols, it's important to acknowledge that no storage or transmission method can guarantee absolute security. You play a crucial role in safeguarding your information by managing your password securely, controlling access to your devices, and logging out of the Inspiring Vacations website when your session concludes.

Should a security incident occur compromising any information within our control, Inspiring Vacations is committed to promptly investigating the matter and, if necessary, notifying affected individuals, activating our incident response plan, and adhering to relevant laws and regulations.

How We Disclose Personal Information

Due to the nature of our service, it is necessary that personal information be provided to both Australian and foreign third parties. Your information may be disclosed to foreign third party operators and service providers who may or may not operate in the country of your destination. Personal information will only be disclosed where we believe it is necessary to fulfil your booking, we believe on reasonable grounds that the third party operator or service provider is compliant with local data privacy laws similar to the APPs, and the EU GDPR or UK GDPR (where applicable), and you have consented for us to do so or it is otherwise required by law.

Inspiring Vacations arranges travel all around the world, so your personal information (including sensitive information and health information) will be disclosed as relevant to hotels, tour operators or third party service providers in and relevant to your chosen country/ies of travel and travel destination/s. We aim to ensure that the overseas recipient of your personal information will protect your personal information in accordance with equivalent or higher data protection practices. Our contracts with third party service providers impose privacy and data protection obligations on them.

Who We Share Your Information With

We won’t share any personal information and sensitive information you give us with anyone outside of Inspiring Vacations, except as specified in this policy, or when required or permitted by law, or with our third party service providers and professional advisors (e.g. accountants, debt collectors, HR consultants, lawyers, etc.) or our related entities that need to have access to the information to provide products or services to us, or on our behalf, or as you have requested.

We protect your personal information and sensitive information, with appropriate security measures, and we require our third party service providers outlined above to comply in a similar fashion.

Retention, Destruction and De-Identification of Personal Information

We take steps to protect the personal information we hold against loss, unauthorised access, use, modification or disclosure and against other misuse. Inspiring Vacations maintains your personal information for a duration aligned with the initial purpose of collection or as mandated by legal requirements. The determination of the appropriate retention period is based on factors such as the volume, nature, and sensitivity of the data, potential risks associated with unauthorised access or disclosure, alternative means of achieving processing objectives, and relevant legal obligations.

Upon expiration of the specified retention periods or when your personal information is no longer needed for any of our business functions, we will take reasonable steps to erase, destroy or permanently de-identify your personal information in compliance with applicable legislation. In cases where complete deletion from our systems is technically unfeasible, suitable security measures will be implemented to prevent further utilisation of such data.

Unless otherwise specified by your request or contractual obligations, Inspiring Vacations retains information for the duration of your account's activity or as necessary to deliver requested services. Subsequent to service termination or deactivation, Inspiring Vacations retains information for as long as required for business and legal obligations, unless earlier deletion is explicitly requested by you or contractually stipulated.

Marketing

You will only receive marketing material where you have provided consent. You may choose to opt out of our mailing list at any time by following the unsubscribe link in the footer of every marketing email or by emailing support@inspiringvacations.com. By necessity, you will continue to receive email communication in relation to your booking.

Some of our marketing activities may be provided or facilitated by third party operators or service providers.

Rights in respect of Personal Information

We will take reasonable steps to ensure that the personal information we use or disclose is accurate, complete and up to date, having regard to the purpose of the use or disclosure.

In Australia, your rights with respect to your own personal information include the following:

● The right to request access to your personal information. This enables you to receive a copy of the personal information we hold about you.

● The right to request correction of your personal information if it is inaccurate. You may also supplement any incomplete personal information we have, taking into account the purposes of the processing.

● The right to lodge complaints about our privacy practices directly to us, and we will respond to your complaint in line with our procedures, in accordance with the Privacy Act and the APPs. Please use our contact details below.

● The right to lodge a complaint to the Office of the Australian Information Commissioner (OAIC), if we have not responded to your complaint, or if you are dissatisfied with our response. We of course would like the first opportunity to attempt to resolve your complaint. 

We have procedures in place for dealing with and responding to requests for access to, and correction of, the personal information held about you.

You will not usually have to pay a fee to access your personal information (or to exercise any of the other rights described in this Statement). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive, or excessive. We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal information (or to exercise any of your other rights). To the extent you use a third party to submit a request on your behalf, we may need to take reasonable steps to verify the authenticity of the request. These are security measures to ensure that personal information is not disclosed to any person who has no right to receive it. In an effort to speed up our response, we may also contact you to ask you for further information in relation to your request.

Our website may also contain links to other websites of interest. Where a link on the Inspiring Vacations website directs you to a third party website, any provision of personal information is no longer to Inspiring Vacations and therefore is not subject to this privacy policy. You acknowledge that Inspiring Vacations is not responsible for any personal information provided to a third party. You should exercise caution and look at the privacy policy applicable to the website in question.

Contests

If you participate in our contests or other promotional activities, we may request your personal information to facilitate contest administration and winner notification. Your participation in our contests is entirely voluntary, providing you with the choice of disclosing the requested information.

Received Emails

The personal data contained in emails we received from you, including email addresses, will solely be utilised for the specified purposes and are governed by the terms outlined in this privacy policy. Transmitting personal information via email is done at your own discretion and we bear no liability for any unauthorised use of this information by third parties. 

Job Applications

Personal information gathered from job applications will only be utilised to assess your application, determine your suitability for the applied role, and facilitate communication with you. Furthermore, de-identified personal information will be utilised for analysis to comprehend applicant demographics, identify potential barriers, and enhance our recruitment practices and job offerings in future. Upon successful application, the information provided will be stored within our Human Resource system to initiate the creation of your employee profile.

Changes To This Privacy Policy

Inspiring Vacations reserves the right to alter this Privacy Policy at any time. Any changes to our Privacy Policy will be uploaded to the website, and a current version of our Privacy Policy is always available from us.

Annexure A 

If you are outside of Australia, and a resident of the European Economic Area (EEA), which covers all countries in the European Union (EU) including Iceland, Liechtenstein and Norway (excluding Switzerland), then the General Data Protection Regulations (EU GDPR) may apply to you. If you are a citizen of the United Kingdom, then the UK General Data Protection Regulation (UK GDPR) may apply to you.

The definition of “Personal Information” that we have used in this Privacy Policy may be different to, or supplemented by, your relevant local data protection laws (eg, EU GDPR and UK GDPR). 

Legal Basis for Processing Personal Information under the EU GDPR and the UK GDPR (if applicable)

If you are from the EEA or the UK, our legal basis for collecting and using the personal information described in this Privacy Policy depends on the personal information we collect and the specific context in which we collect it. We have specified the relevant ground for processing in this section and set out above describing ways in which we use your data. We rely on the following grounds:

(c) The processing is in our legitimate interests, and it is not overridden by your rights; and

● The right to be informed. Inspiring Vacations provides you with privacy information at the time we collect personal data from you, through this privacy policy

● The right to request access to your personal information. This enables you to receive a copy of the personal information we hold about you.

● The right to request correction of or rectification / updates to, your personal information if it is inaccurate. You may also supplement any incomplete personal information we have, taking into account the purposes of the processing. You will be able to change some information we hold in your account settings. Otherwise, please contact us for us to assist you.

● The right to request deletion or erasure of your personal information if:

  • your personal information is no longer necessary for the purposes for which we collected or processed them; or
  • you withdraw your consent if the processing of your personal information is based on consent and no other legal ground exists; or
  • you object to the processing of your personal information and we do not have an overriding legitimate ground for processing; or
  • your personal information is unlawfully processed; or
  • your personal information must be deleted for compliance with a legal obligation.

● The right to object to the processing of your personal information. We will comply with your request, unless we have a compelling overriding legitimate interest for processing or we need to continue processing your personal information to establish, exercise, or defend a legal claim.
